1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the kovaa website, mobile app, training plans, analytics, notifications, support services, and related features (the "Service"). By downloading, installing, accessing, subscribing to, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use kovaa.

2. Eligibility and Account Security

You must be at least 18 years old to use kovaa. You are responsible for the accuracy of your account information, the confidentiality of your login credentials, and all activity under your account. Notify us promptly if you believe your account has been compromised.

3. The kovaa Service

kovaa provides endurance training tools, structured running and triathlon plans, workout scheduling, performance analysis, recovery insights, and coaching recommendations. The Service may use data you enter, workouts you record, Apple Health data you authorize, and other information you provide to personalize your experience.

We may change, suspend, or discontinue features at any time. We may also update training plans, algorithms, pricing, supported integrations, and device requirements as the Service evolves.

4. Fitness, Health, and Medical Disclaimer

kovaa is a fitness and training product. It is not a medical device, healthcare provider, emergency service, diagnostic tool, or substitute for professional medical advice, diagnosis, or treatment.

Consult a qualified healthcare professional before starting or changing an exercise program.
Stop exercising and seek medical attention if you experience chest pain, dizziness, fainting, unusual shortness of breath, or concerning symptoms.
Training recommendations may be incomplete, inaccurate, or unsuitable for your individual condition.
You are responsible for deciding whether a workout, route, intensity, or recommendation is safe for you.

5. Automated Coaching and Recommendations

kovaa uses deterministic software to summarize training, suggest workouts, adapt schedules, explain trends, or generate coaching feedback. Recommendations are informational only and may be wrong, incomplete, or based on imperfect data. Do not rely on recommendations for medical decisions, emergency guidance, or decisions that require professional judgment.

You are responsible for reviewing recommendations before acting on them. kovaa 1.0 does not use OpenAI or another external generative-AI provider to process user training data.

6. Apple Health and Device Data

If you choose to connect Apple Health, kovaa will request access only to the data types needed to provide fitness functionality, such as workouts, activity, heart rate, sleep, HRV, and related recovery metrics. Apple Health permissions are optional and controlled by you through iOS settings and the Apple Health app.

We do not use Apple Health data for advertising or sell Apple Health data. Apple Health data is used to provide, personalize, secure, and improve fitness features as described in our Privacy Policy.

7. Connected Services

kovaa 1.0 supports optional Apple Health import and Strava connectivity. Both are optional and controlled by you; additional providers may be enabled only after kovaa updates its disclosures and applicable terms.

8. Subscriptions, Trials, Billing, and Refunds

kovaa may offer free and paid features, including auto-renewing subscriptions and one-time lifetime access purchased through the Apple App Store. Prices, durations, trial availability, and included features are shown before purchase and may change for future billing periods.

Payment is charged through your Apple App Store account at confirmation of purchase.
Subscriptions renew unless canceled through the applicable store account, subject to that store's timing and renewal rules.
Deleting your kovaa account does not cancel an Apple App Store subscription.
Purchase restoration will be available for eligible purchases made with the same store account once subscriptions launch.
Refunds and billing disputes are governed by the store that processed the purchase.

9. Apple App Store Terms

If you download kovaa from the Apple App Store, these Terms are between you and kovaa, not Apple. Apple is not responsible for the Service, support, maintenance, claims, or warranty obligations except as required by applicable law. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you. Your use of kovaa must also comply with the Apple Media Services Terms and the App Store rules that apply to your device and Apple ID.

10. Acceptable Use

You agree not to:

Use kovaa unlawfully, fraudulently, or in a way that harms others.
Reverse engineer, scrape, overload, probe, or interfere with the Service.
Share your account, impersonate others, or misrepresent training, identity, or payment information.
Upload malicious, infringing, deceptive, or unlawful content.
Use kovaa to provide commercial coaching, medical, or professional services without our written permission.

11. Your Content and Data

You keep ownership of information you provide to kovaa, including profile details, goals, workouts, activities, feedback, and files. You grant kovaa a limited license to host, process, analyze, display, and use that content as needed to operate, secure, personalize, support, and improve the Service.

You are responsible for making sure you have the rights and permissions needed to submit or sync any data to kovaa.

12. Intellectual Property

kovaa owns the Service, software, designs, trademarks, content, training plan structures, analytics, interfaces, and related intellectual property, except for your content and third-party materials. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own training.

13. Privacy, Data Rights, and Account Deletion

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal data, fitness data, location data, Apple Health data, and automated-service data. You can request account and data deletion through the app or at kovaasport.com/data-deletion.

14. Third-Party Services

kovaa may link to or integrate with third-party services, including Apple, Google, payment providers, analytics providers, cloud infrastructure, notification providers, and support tools. We do not control third-party services and are not responsible for their content, policies, availability, or practices.

15. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.

16. Limitation of Liability

To the fullest extent permitted by law, kovaa will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, training outcomes, race results, service interruption, or unauthorized access. Our total liability for any claim is limited to the greater of $100 or the amount you paid to kovaa in the 12 months before the claim.

17. Indemnification

You agree to defend, indemnify, and hold harmless kovaa from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your content, your violation of these Terms, or your violation of law or third-party rights.

18. Suspension and Termination

We may suspend or terminate access if we believe you violated these Terms, created risk, failed to pay, misused integrations, or used the Service unlawfully. You may stop using kovaa at any time and may request account deletion. Sections that by their nature should survive termination will survive.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law rules. Courts located in California will have exclusive jurisdiction unless applicable consumer protection laws require a different forum.

20. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice in the app, on the website, by email, or by another reasonable method. Your continued use after the effective date means you accept the updated Terms.
