Terms of Service

1. Agreement to Terms

By downloading, accessing, or using the kovaa mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and kovaa.

2. Description of Service

kovaa provides adaptive personalized training plans for triathlons, running, and endurance sports. The App offers features including workout planning, progress tracking, performance analytics, and training recommendations. kovaa is available on a subscription basis with a free trial period.

3. Eligibility

You must be at least 13 years old to use kovaa. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.

4. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

You may not share your account or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription and Payment Terms

5.1 Subscription Plans

kovaa offers the following subscription options:

  • Free Plan: Limited access to basic features
  • Pro Monthly: $7.99/month with full access to all features
  • Pro Yearly: $74.99/year (equivalent to $6.24/month, save 22%)

5.2 Free Trial

New users may be eligible for a 7-day free trial of the Pro subscription. You will not be charged during the trial period. If you do not cancel before the trial ends, you will automatically be charged for the subscription plan you selected.

5.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel before the renewal date. You will be charged through your Apple App Store account. The renewal charge will be the same as the original subscription price unless we notify you of a price change in advance.

5.4 Payment Processing

All payments are processed securely through Apple's App Store. We do not store your payment information. By subscribing, you authorize Apple to charge your payment method for the subscription fees.

5.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals. We will notify you of price changes at least 30 days in advance.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your subscription at any time through your Apple App Store account settings. Cancellation will take effect at the end of your current billing period. You will retain access to Pro features until the end of the paid period.

To cancel:

  • Open the Settings app on your iOS device
  • Tap your name, then tap Subscriptions
  • Select kovaa and tap Cancel Subscription

6.2 Refund Policy

Refunds are handled by Apple according to their refund policy. Generally, subscriptions are non-refundable, but you may request a refund from Apple within a reasonable time after purchase. To request a refund:

We do not have the ability to issue refunds directly. All refund requests must go through Apple.

7. Medical Disclaimer

IMPORTANT: kovaa is a fitness training tool and is not a substitute for professional medical advice, diagnosis, or treatment.

  • Always consult with a qualified healthcare provider before starting any new exercise program
  • If you experience pain, dizziness, or discomfort during exercise, stop immediately and seek medical attention
  • kovaa's training recommendations are generated by our adaptive engine and may not be suitable for everyone
  • We are not responsible for injuries, health issues, or adverse effects resulting from following training plans
  • You assume all risks associated with using the App and following training recommendations

By using kovaa, you acknowledge that you are physically capable of participating in endurance training and that you have consulted with a healthcare provider if you have any medical concerns.

8. User Responsibilities and Conduct

You agree to use kovaa only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to the App or our systems
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for commercial purposes without our permission
  • Share your account credentials with others
  • Use automated systems (bots, scrapers) to access the App
  • Interfere with or disrupt the App's functionality

9. Intellectual Property Rights

The App, including all content, features, functionality, software, code, designs, graphics, and trademarks, is owned by kovaa and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You retain ownership of any data you input into the App. By using the App, you grant us a license to use your data to provide and improve our services as described in our Privacy Policy.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOVAA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the App
  • Any injuries, health issues, or adverse effects from following training plans
  • Unauthorized access to or alteration of your data
  • Any third-party content or conduct on the App
  • Any interruption or cessation of the App

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected
  • Training plans will achieve specific results or meet your expectations

12. Indemnification

You agree to indemnify, defend, and hold harmless kovaa and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any injuries or health issues resulting from your use of the App

13. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination:

  • Your right to use the App will immediately cease
  • You will lose access to your account and data
  • You will not be entitled to a refund of any subscription fees

You may terminate your account at any time by canceling your subscription and deleting the App.

14. Dispute Resolution and Arbitration

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action lawsuit. Arbitration will take place in the United States.

If you are a resident of the European Union, you may have the right to bring disputes before your local courts or consumer protection authorities.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and cancel your subscription.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and kovaa regarding your use of the App and supersede all prior agreements and understandings.
